1. Acceptance
By accessing or using ProVaidya (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
2. Tester program
ProVaidya is currently released to a limited group of testers for evaluation. The Service is provided as a prototype, may change without notice, and may contain bugs or incomplete features. It is not certified medical software and must not be relied on as the sole system of record for patient care during this period.
3. Eligibility & accounts
You must be a licensed healthcare practitioner or an authorized member of a practitioner's team to use the Service. You are responsible for the accuracy of your account information and for all activity under your account. Keep your credentials confidential and notify us of any unauthorized access.
4. Clinical responsibility
The Service assists practitioners; it does not practice medicine. All clinical decisions — including diagnoses, prescriptions, and care plans — remain the sole responsibility of the treating clinician. AI-generated summaries, drafts, and suggestions are advisory only and must be reviewed before use.
5. Your data & FHIR servers
Clinical data you enter is stored on the FHIR server you have configured. You are responsible for ensuring you have the legal right to store patient information on that server and to process it via the Service. You retain ownership of your data.
6. Acceptable use
- Do not attempt to breach security, bypass the FHIR proxy, or access data you are not authorized to access.
- Do not use the Service for unlawful purposes, harassment, or to violate patient privacy.
- Do not reverse-engineer, scrape, or overload the Service.
- Do not upload malware or content you do not have the right to upload.
7. Third-party services
The Service integrates with third parties (authentication providers, AI gateways, FHIR servers, hosting). Your use of those services may be subject to their own terms. We are not responsible for third-party services or content.
8. Intellectual property
The Service, including its code, design, and content (excluding your data), is owned by ProVaidya and its licensors and is protected by applicable laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.
9. Suspension & termination
We may suspend or terminate your access at any time if you violate these Terms, if required by law, or if we discontinue the tester program. You may stop using the Service and request account deletion at any time.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI OUTPUTS WILL BE ACCURATE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROVAIDYA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU TO US IN THE PRIOR 12 MONTHS OR (B) INR 1,000.
12. Indemnity
You agree to indemnify and hold ProVaidya harmless from claims arising out of your use of the Service, your data, or your violation of these Terms or applicable law.
13. Governing law
These Terms are governed by the laws of India. Courts in Bengaluru, Karnataka, will have exclusive jurisdiction, subject to any mandatory local law that provides otherwise.
14. Changes
We may update these Terms as the Service evolves. Material changes will be communicated in-app or by email. Continued use of the Service after changes take effect constitutes acceptance.
